Bankruptcy

Stuart Law has appeared in numerous bankruptcy courts across the United States representing creditors’ rights. Adversary proceedings have included enforcement actions, procedural disputes, proofs of claims, turnovers, fraudulent conveyances, as well as litigation with U.S. Trustees involving interpretation of state, federal and bankruptcy law.

Business Law

Stuart Law provides a full range of business organization and operation services, including but not limited to selecting the best form of business entity; organizing for-profit corporations and limited liability companies; incorporating charitable non-profits and obtaining their tax exempt status; and advising and documenting the operation of major business organizations.

We counsel our business clients on a full range of business law issues, including contract negotiation, employment law, franchise and royalty agreements, debtor/creditor law and business torts. While many disputes can be resolved favorably through negotiation, when the need arises Stuart Law zealously represents its clients in litigation to protect their rights.

Housing Finance

Stuart Law is well known for its work in developing and financing affordable housing, serving at various times as developer's counsel, lender's counsel, syndicator's counsel, and investor's counsel. Our extensive experience with land use regulations, real estate, the organization of non-profits, and federal and state housing programs (including federal and state low income housing tax credits) place us in a unique position to offer in-depth guidance, counsel and problem solving services.

Insurance Regulatory

Stuart Law has an extensive track record with insurance regulators in North Carolina and other states. We have successfully organized two mutual property and casualty insurance companies in North Carolina, negotiated foreign insurance company admissions and handled rate and compliance issues with regulators in several states. With attorneys licensed to practice in North Carolina, South Carolina, Virginia and Tennessee, we have a regional presence in this area of practice.

Intellectual Property

Stuart Law's business and sports practices have served to lead us into the world of intellectual property. We have represented our clients before the U.S. Patent and Trademark Office to obtain trademark and service mark protection for various products and services. We are also experienced in negotiating with the holders of potentially conflicting marks to resolve disputes without the expense of protracted litigation.

Municipal Bond Finance

Stuart Law is known in the regional and national financial markets through its housing finance practice. We have served as borrower's counsel, issuer's counsel, underwriter's counsel, and bond counsel in various tax exempt bond offerings to finance affordable housing. Our more than twenty years of experience have earned Stuart Law a listing as bond counsel in the Bond Buyer's Municipal Marketplace, the preeminent directory of accredited bond attorneys and municipal finance professionals.

Sports Law

Stuart Law has represented professional athletes and coaches in sports contract negotiations for more than 20 years. We also perform legal services for national and regional sports competitions and their governing bodies, including the U.S. Olympic Festival-1987; Raleigh's bid to host the 2007 Pan American Games; North Carolina Amateur Sports; the North Carolina Sports Development Commission; the State Capitol Sports Institute; and USA Baseball. Our sports law and workers' compensation practices converge in the representation of injured athletes in workers' compensation matters.

Tax-Exempt Organizations

Stuart Law advises many charitable organizations and foundations. From the initial stages of incorporation and obtaining tax-exempt status through operational and compliance issues such as unrelated business income ("UBIT"), we provide advice and counsel on organizational, legal, tax exemption and operational matters for non-profits.

Workers Compensation

Stuart Law defends workers' compensation claims for employers, insurers and the North Carolina Self-Insurance Security Association. We are particularly active in defending complex cases in which claimants seek large recoveries. In addition, Stuart Law serves as coverage counsel to advise insurers on complex claims and we accept plaintiffs' cases for sports related injuries.
